Turkish legal support for UK-based clients

Cross-border question often start with uncertainty; which law applies, what documents are needed and where risk sits. We provide expert legal insight and strategic guidance across the following core areas of Turkish law.

PROPERTY PURCHASES / SALES

Navigating the Turkish real estate market from abroad can be complex and carries significant financial and legal risks.

Whether you are purchasing a dream home, investing in commercial property or selling inherited real estate in Türkiye, we provide comprehensive legal guidance to ensure your transaction is secure, transparent, and legally sound.

We protect your interests at every stage of the process, saving you time and preventing costly errors.

  • Comprehensive Due Diligence: Investigating property titles (Tapu), zoning statuses, liens or any hidden encumbrances before you commit to a purchase.
  • Contract Drafting & Review: Preparing and reviewing preliminary sales agreements (Satış Vaadi Sözleşmesi) and ensuring all terms protect your rights.
  • Remote Transaction Management: Handling the entire buying or selling process through a Power of Attorney (Vekaletname) from the UK, so you don't need to travel to Türkiye.
  • Secure Fund Transfers: Guiding you through legally compliant and secure cross-border fund transfers and bank processes.
  • Turkish Citizenship by Investment: Providing expert legal support if your property purchase is aimed at acquiring Turkish Citizenship.
  • Post-Purchase & Dispute Resolution: Assisting with title deed transfers, tax registrations, and resolving any post-sale property disputes.
INHERITENCE AND PROBATE MATTERS

Navigating succession law and managing estate assets in Türkiye from the United Kingdom requires a clear understanding of the Turkish civil law system, which enforces strict rules on statutory heirs and reserved shares (saklı pay). We provide structured legal guidance to ensure the seamless resolution of cross-border estate matters, safeguarding your legal rights and interests without requiring your physical presence in Türkiye.

  • Obtaining Certificates of Inheritance: Securing the necessary legal documents from Turkish courts or notaries (Veraset İlamı) to officially recognise legal heirs.
  • Asset Location & Discovery: Investigating and identifying the deceased’s assets across Türkiye, including bank accounts, real estate, vehicles, and corporate shares.
  • Estate Administration & Asset Transfer: Managing the entire probate process through a Power of Attorney (Vekaletname) from the UK, including the settlement of inheritance taxes (Veraset ve İntikal Vergisi) and the transfer of title deeds.
  • Cross-Border Estate Coordination: Advising on the interaction between UK wills and Turkish inheritance laws to facilitate correct asset distribution.
  • Inheritance Disputes & Litigation: Representing your interests before Turkish courts in cases involving disputed wills, unfair asset transfers prior to death (muris muvazaası), or violations of reserved legal shares.
  • Liquidation & Repatriation of Funds: Assisting in the legal sale of inherited assets and guiding you through the secure transfer of the proceeds back to the United Kingdom.
COMPANY FORMATION AND CORPORATE MATTERS

Expanding a business across borders or managing a corporate entity in Türkiye from the United Kingdom involves navigating dynamic regulatory landscapes, compliance requirements, and complex commercial laws. We provide strategic legal consultancy to British entrepreneurs, Turkish expats, and international businesses seeking to establish, operate, or restructure corporate entities in Türkiye. Our focus is on mitigating risk and ensuring full statutory compliance.

  • Company Incorporation & Structuring: Advising on the most appropriate legal structure (Joint-Stock Companies, Limited Liability Companies, or Liaison Offices) and managing the complete registration process with Turkish Trade Registries.
  • Share Transfers & Restructuring: Drafting and executing Share Purchase Agreements (SPAs), managing share transfers (hisse devri), changing company directors, and updating corporate registries.
  • Capital Increases & Reductions: Navigating the legal and bureaucratic procedures for increasing (sermaye artırımı) or reducing corporate capital, including preparing general assembly resolutions.
  • Corporate Governance & Compliance: Providing ongoing advice on board resolutions, amending articles of association, and ensuring full compliance with the Turkish Commercial Code.
  • Remote Corporate Management: Executing all corporate actions remotely through a Power of Attorney (Vekaletname), minimizing the need for corporate officers to travel to Türkiye.
  • Foreign Investment & Liaison Offices: Assisting UK businesses in establishing Liaison Offices (İrtibat Bürosu) or branch offices in Türkiye, including navigating Ministry regulations.
  • Commercial Contracts: Drafting, reviewing, and negotiating bilingual shareholder agreements, joint venture agreements, and cross-border commercial contracts.
POWERS OF ATTORNEY AND NOTARIAL PROCEDURES

Executing legal transactions in Türkiye from the United Kingdom heavily relies on correctly prepared Powers of Attorney (Vekaletname) and cross-border documentation. Minor drafting errors or procedural omissions can lead to severe delays or the complete rejection of documents by Turkish authorities, land registries (Tapu), or banks. We provide expert guidance on drafting the correct legal texts and advise you on the necessary steps to make your UK documents legally valid in Türkiye.

  • Drafting Custom Powers of Attorney: Preparing tailored, legally sound text for Powers of Attorney in Turkish and English, ensuring the scope of authority perfectly matches your transaction in Türkiye (e.g., property sale, inheritance, or corporate management).
  • Bilingual Documentation Support: Verifying and structuring bilingual corporate documents, board resolutions, or certificates of incumbency to ensure they comply with Turkish regulatory expectations.
  • Revocation of Authority: Drafting the necessary legal text (azilname) to safely revoke existing Powers of Attorney and protect your assets in Türkiye.
COURT PROCEEDINGS & DISPUTE RESOLUTION IN TÜRKIYE

Resolving legal disputes before Turkish courts while residing in the United Kingdom requires rigorous case strategy, local procedural expertise, and continuous monitoring. We act as your strategic legal partner in the UK, managing and coordinating your litigation and alternative dispute resolution (ADR) matters in Türkiye. We ensure your cases are handled effectively, providing you with transparent updates and clear risk assessments throughout the proceedings.

  • Litigation Strategy & Management: Formulating comprehensive legal strategies for civil, commercial, and administrative lawsuits before Turkish courts, and managing the filing of claims and responses.
  • Alternative Dispute Resolution (ADR): Guiding clients through mandatory and voluntary mediation (arabuluculuk) processes in Türkiye to resolve disputes efficiently outside the courtroom.
